1. Acceptance of Terms

Welcome to Clear Waste Solutions. By accessing our website at clearwastedsolutions.com, scheduling a service, or engaging with Clear Waste Solutions in any capacity, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services.

These Terms apply to all visitors, customers, and others who access or use our services, including junk removal, dumpster rental, and construction debris hauling throughout South Florida.

We reserve the right to update or modify these Terms at any time without prior notice. Your continued use of our services following any changes constitutes your acceptance of the revised Terms. We encourage you to review this page periodically.

2. Services Description

Clear Waste Solutions provides the following services in Miami-Dade, Broward, and Palm Beach counties:

• Junk Removal: On-demand removal of household, commercial, and miscellaneous items from your property. Our crew handles all loading and hauling.
• Dumpster Rental: Delivery and pickup of roll-off dumpsters in various sizes (10, 20, 30, and 40 yard) for residential and commercial projects.
• Construction Debris Hauling: Removal of construction waste, demolition debris, concrete, drywall, roofing materials, and other jobsite materials.
• Specialty Services: Estate cleanouts, foreclosure cleanouts, eviction cleanouts, office cleanouts, appliance removal, furniture removal, mattress disposal, and hot tub removal.

Service availability may vary by location and scheduling demand. Clear Waste Solutions reserves the right to decline any job at our discretion, including but not limited to jobs involving hazardous materials, unsafe conditions, or items outside the scope of our services.

3. Pricing & Payment

All pricing provided by Clear Waste Solutions is based on the volume of material, type of debris, location, and any additional labor required. Quotes are estimates unless explicitly stated as a flat rate.

• Quotes: Free, no-obligation quotes are provided in person, over the phone, or via our online form. Final pricing may be adjusted onsite if the scope of work differs from the original description.
• Dumpster Rental Pricing: Dumpster rental rates include delivery, pickup, a specified rental period, and a weight allowance. Overages for extended rental periods or excess weight will be billed separately at the rates disclosed at the time of rental.
• Payment Methods: We accept cash, credit cards, debit cards, checks, Zelle, and other forms of electronic payment. Payment is due upon completion of service unless other arrangements have been agreed upon in writing.
• Additional Charges: Additional fees may apply for same-day service, after-hours service, difficult access (stairs, narrow driveways, long carry distances), sorting requirements, or disposal of specialty items.

Prices are subject to change without notice. However, any quote provided for a specific job will be honored for 7 days from the date it was issued.

4. Cancellation Policy

We understand that plans change. Our cancellation policy is as follows:

• Junk Removal: Cancellations made at least 24 hours before the scheduled appointment are free of charge. Cancellations made with less than 24 hours' notice may be subject to a cancellation fee.
• Dumpster Rental: Cancellations made before the dumpster has been dispatched for delivery are free of charge. Once a dumpster has been dispatched or delivered, standard delivery and pickup fees apply.
• Rescheduling: We are happy to reschedule your service at no additional cost, subject to availability, provided you give at least 24 hours' notice.
• No-Shows: If our crew arrives at your location and is unable to access the property or perform the agreed-upon work due to circumstances within your control, a trip fee may be charged.

5. Liability Limitations

Clear Waste Solutions carries general liability insurance and takes every precaution to protect your property during service. However, our liability is limited as follows:

• Clear Waste Solutions is not liable for any pre-existing damage to driveways, sidewalks, landscaping, or other surfaces that may be affected during dumpster placement or junk removal operations.
• Our total liability for any claim arising from our services shall not exceed the total amount paid by you for the specific service in question.
• Clear Waste Solutions is not responsible for indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities.
• We are not liable for delays or failures in performance caused by circumstances beyond our reasonable control, including weather, road conditions, traffic, equipment failure, natural disasters, or government actions.

Any claims for damage must be reported within 48 hours of service completion. Claims reported after this period may not be honored.

6. Property Access & Damage

By scheduling a service with Clear Waste Solutions, you agree to the following:

• Access: You will provide safe and clear access to the items to be removed or the area where a dumpster is to be placed. This includes clearing pathways, unlocking gates, and ensuring adequate space for our vehicles and equipment.
• Authorization: You represent and warrant that you are the property owner or have authorization from the property owner to request services at the specified location.
• Surface Damage: Heavy equipment and dumpsters can cause damage to driveways, lawns, and other surfaces. While we take care to minimize impact, you acknowledge that some surface wear may occur and release Clear Waste Solutions from liability for normal wear.
• Dumpster Placement: You are responsible for obtaining any necessary permits for dumpster placement on public property (e.g., streets, sidewalks). Clear Waste Solutions can provide guidance on permit requirements but is not responsible for securing permits on your behalf.
• Overhead Obstructions: You must inform us of any overhead power lines, tree branches, or other obstructions at the placement site. Clear Waste Solutions is not responsible for damage caused by undisclosed obstructions.

7. Prohibited Items

Clear Waste Solutions cannot accept the following items for removal or in rental dumpsters. You are responsible for ensuring that prohibited items are not included in your removal request or placed in a rented dumpster:

• Hazardous materials (paints, solvents, chemicals, pesticides, oil, gasoline, antifreeze)
• Asbestos or asbestos-containing materials
• Medical or biological waste
• Radioactive materials
• Explosives, ammunition, or firearms
• Batteries (automotive or industrial)
• Tires (unless specifically agreed upon and priced separately)
• Propane tanks or pressurized cylinders
• Any materials prohibited by local, state, or federal law

If prohibited items are discovered in a dumpster or among items scheduled for removal, you will be responsible for all additional costs associated with proper disposal, including fines, surcharges, and cleanup fees.

8. Indemnification

You agree to indemnify, defend, and hold harmless Clear Waste Solutions, its owners, officers, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use of our services
• Your breach of these Terms
• Your violation of any applicable law or regulation
• Any misrepresentation made by you regarding property ownership, authorization, or the nature of items to be removed
• The presence of prohibited or hazardous materials that you failed to disclose
• Any third-party claims related to your use of our services

9. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions.

Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Miami-Dade County, Florida. You consent to the personal jurisdiction of such courts and waive any objection to venue in such courts.

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect. The failure of Clear Waste Solutions to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
